3. Eligibility and Account Registration
3.1 Eligibility
You must be at least 18 years old and legally capable of entering into contracts to use our Services. By using our Services, you represent and warrant that you meet these requirements.

To access certain Services, you must create an account by providing accurate, current, and complete information. You are responsible for:

- All activities that occur under your account

6. Service Availability and Performance

Service availability depends on network coverage in your area. Coverage maps are estimates and actual service may vary based on terrain, weather, and other factors.
6.2 Service Interruptions
We strive to provide continuous service but cannot guarantee 100% uptime. Service may be interrupted for:
- Scheduled maintenance and network upgrades
- Emergency repairs and technical issues
- Acts of God and force majeure events
- Third-party network or infrastructure failures
6.3 Fair Use Policy
To ensure network quality for all users, we may implement fair use policies including:
- Data deprioritization after certain usage thresholds

- Extraordinary network abuse
11. Warranties and Disclaimers

We warrant that our Services will be provided with reasonable care and skill. However, telecommunications services are subject to various factors beyond our control.
11.2 Disclaimer
EXCEPT AS EXPRESSLY STATED, SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR LIABILITY FOR ANY DAMAGES ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR SERVICES IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.
WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION.
13. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Services, violation of these Terms, or infringement of third-party rights.
14. Dispute Resolution

We are committed to providing accessible services and comply with applicable accessibility standards including the Americans with Disabilities Act (ADA) and EN 301 549 European Standard.
18. Changes to Terms
We may modify these Terms periodically. Material changes will be communicated through:

- In-app notifications
Continued use of Services after changes constitutes acceptance of the modified Terms.
19. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
20. Entire Agreement
These Terms, together with our Privacy Policy and any service-specific terms, constitute the entire agreement between you and IonMesh regarding the Services.
21. SMS and Text Messaging Services

IonMesh provides SMS text messaging services to customers who opt-in to receive communications. These services include Service updates, account notifications, customer support.
21.2 Consent and Opt-In
By providing your mobile phone number and consenting to receive SMS messages, you agree to receive text messages from IonMesh.
21.3 Message Frequency
Message frequency varies. The frequency of messages depends on your account activity, service updates, and customer interactions.
21.4 Message and Data Rates
Message and data rates may apply. Standard text messaging rates from your wireless carrier will apply. Check with your carrier for details on your specific plan.
21.5 Help and Support

21.6 Opt-Out Instructions
You may opt out of SMS messages at any time by texting STOP to the number you received messages from. You will receive a confirmation message. You may also opt out by:

- Updating your preferences in your customer portal

21.7 Supported Carriers
Our SMS services are available on major US wireless carriers. Message delivery may vary based on carrier and device capabilities.
21.8 Age Restrictions
SMS services are only available to individuals 18 years of age or older, or minors with parental consent.
